E-WASTE

  1. Short title and commencement. - (1) These rules may be called the E-Waste (Management) Rules, 2016. (2) They shall come into force from the 1st day of October, 2016.
  2. Application. - These rules shall apply to every manufacturer, producer, consumer, bulk consumer, collection centers, dealers, e-retailer, refurbisher, dismantler and recycler involved in manufacture, sale, transfer, purchase, collection, storage and processing of e-waste or electrical and electronic equipment listed in Schedule I, including their components, consumables, parts and spares which make the product operational.
  3. CPCB - 'Central Pollution Control Board' means the Central Pollution Control Board constituted under sub-section (1) of section 3 of the Water (Prevention and Control of Pollution) Act, 1974 (6 of 1974);
  4. ‘Collection center' means a center or a collection point or both established by producer individually or as association jointly to collect e-waste for channelizing the e-waste to recycler and play such role as indicated in the authorization for Extended Producer Responsibility granted to the producer and having facilities as per the guidelines of Central Pollution Control Board, including the collection Centre established by the dismantler or refurbisher or recycler which should be a part of their authorization issued by the State Pollution Control Board where the facility exists
  5. ‘Component’ means one of the parts of a sub-assembly or assembly of which a manufactured product is made up and into which it may be resolved and includes an accessory or attachment to another component;
  6. Disposal - ‘component’ means one of the parts of a sub-assembly or assembly of which a manufactured product is made up and into which it may be resolved and includes an accessory or attachment to another component.
  7. 'Electrical and electronic equipment' means equipment which are dependent on electric current or electro-magnetic field in order to become functional
  8. EPR - ‘Extended Producer Responsibility’ means responsibility of any producer of electrical or electronic equipment, for channelization of e-waste to ensure environmentally sound management of such waste. Extended Producer Responsibility may comprise of implementing takeback system or setting up of collection centers or both and having agreed arrangements with authorized dismantler or recycler either individually or collectively through a Producer Responsibility Organization recognized by producer or producers in their Extended Producer Responsibility – Authorization.
  9. Responsibilities of collection centers. -
    • collect e-waste on behalf of producer or dismantler or recycler or refurbisher including those arising from orphaned products; Provided the collection centers established by producer can also collect e-waste on behalf of dismantler, refurbisher and recycler including those arising from orphaned products
    • ensure that the facilities are in accordance with the standards or guidelines issued by Central Pollution Control Board from time to time;
    • ensure that the e-waste collected by them is stored in a secured manner till it is sent to authorized dismantler or recycler as the case may be;
    • ensure that no damage is caused to the environment during storage and transportation of e-waste;
    • maintain records in Form-2 of the e-waste handled as per the guidelines of Central Pollution Control Board and make such records available for scrutiny by the Central Pollution Control Board or the concerned State Pollution Control Board as and when asked for.
  10. Procedure for storage of e-waste. - Every manufacturer, producer, bulk consumer, collection center, dealer, refurbisher, dismantler and recycler may store the e-waste for a period not exceeding one hundred and eighty days and shall maintain a record of collection, sale, transfer and storage of wastes and make these records available for inspection:
    Provided that the concerned State Pollution Control Board may extend the said period up to three hundred and sixty five days in case the waste needs to be specifically stored for development of a process for its recycling or reuse.
  11. Transportation of e-waste. - The transportation of e-waste shall be carried out as per the manifest system whereby the transporter shall be required to carry a document (three copies) prepared by the sender, giving the details as per Form-6:
    Provided that the transportation of waste generated from manufacturing or recycling destined for final disposal to a treatment, storage and disposal facility shall follow the provisions under Hazardous Wastes (Management, Handling and Trans boundary Movement) Rules, 2008
  12. Accident reporting.- Where an accident occurs at the facility processing e-waste or during transportation of e-waste, the producer, refurbisher, transporter, dismantler, or recycler, as the case may be, shall report immediately to the concerned State Pollution Control Board about the accident through telephone and e-mail.

What is E-waste and Why are we involved?

E-waste refers to waste electrical and electronic equipment, whole or in part or rejects from their manufacturing and repair process, which are intended to be discarded. In recent years, there has been an increasing use and dependence on electrical and electronic gadgets like computers, mobile phones, servers, data storage devices, photo copy machines, televisions, washing machines, refrigerators, air conditioners, etc. resulting into generation of large quantities of E-waste.

Recycling raw materials Scientifically from end-of-life electronics is the most effective solution to the growing e-waste problem. E- Waste typically consists of Metals, Plastics, Cathode Ray Tubes, Printed Circuit Board, Cables and so on. Valuable Metals such as copper, silver, gold and Platinum could be recovered from E-Waste if scientifically processed and that can be for future uses. By dismantling and providing reuse possibilities, intact natural resources are conserved and air and water pollution caused by hazardous disposal is avoided.

Incineration of E-waste is associated with the risk of generating and dispersing contaminated and toxic substances. The gases released during the burning, and the residue ash is often toxic and harmful for both, health and environment. The presence of heavy metals and highly toxic substances such as mercury, lead, beryllium and cadmium pose a significant threat to the environment even in minute quantities. Hence, recycling reduces the amount of greenhouse gas emissions caused by incorrect disposal techniques and also the manufacturing of new products.

WHAT IS E-WASTE

Electronic Waste or E- Waste means electrical and electronic equipment, whole or in part discarded as waste by the consumer as well as rejected from manufacturing, refurbishment and repair process.

Electronic waste or e-waste describes discarded electrical or electronic devices. Used electronics which are destined for reuse, resale, salvage, recycling or disposal are also considered e-waste. Informal processing of e-waste in developing countries can lead to adverse human health effects and environmental pollution.

METHODS OF DISPOSAL OF E-WASTE

Disassembly / Dismantling:

It is the systematic removal of components, parts or a group of parts or a subassembly from a product in E-waste.

Upgrading:

It includes commuting and separation of materials using mechanical/physical or metallurgical processing. Methods to recover materials include incineration and refining.

Materials recovery:

The materials are recovered by recycling facilities. The plastic, glass, metals can be recovered by sorting them before mixing them with other waste.

    All products manufactured, imported or sold by Eltech Appliances Pvt. Ltd alone can be recycled through the program. If you want to recycle products of another company, then kindly contact the authorized recycler of the concerned company.

  • How to identify that this is an e-waste product?

    Any electrical or electronic part/product/accessories having wires / PCB and, it is not usable and cannot be repaired

  • Do consumers have to pay to get their products disposed?

    Consumers do not have to pay any money either to Eltech Appliances Pvt. Ltd or its authorized recycler for collection and disposal of their products.

  • Which are the locations from where the products can be disposed?

    Our authorized recycler has pan-India presence and products can be disposed off/collected from your doorsteps across all locations in India.

  • Once a call is registered on the customer care number, how much time will it take for the authorized recycler to come and collect the ?

    It will take approximately 7-10 days for the authorized recycler to come and collect the product from your residence/premises. However, the period may vary depending on the location. Eltech Appliances Pvt. Ltd being a mere facilitator shall not be responsible for any delay in this regard.

  • Can I drop off my products at the nearest Eltech Appliances dealer or service center?

    No. The product has to be handed over to our authorized recycler only.

  • Why re-cycling should be done? Benefits?

    Recycling of old electronic product is beneficial in following ways:

    There is need to encourage recycling of all useful and valuable material from e-waste so as to conserve the ever depleting natural resources. Recycling end-of-life products is vital if we are to save resources and minimize waste.

    Also scientific disposal of e-waste reduces the environment pollution. The correct disposal ofold product will help prevent potential negative consequences for the environment and human health.

  • What are the negative consequences if proper recycling is not done?

    Any disposal through unauthorised agencies/person will attract action under Environment (Protection) Act 1986, which provides for imprisonment upto 5 years or with fine upto Rs. 1 Lac or both.

    Followings are negative consequences of disposal of product if not done in scientific way : Toxic material present in e-waste get mixed with earth, air, water etc and causes health issues.

    Oil & Gases which is present is some of e-waste like compressor and CRT causes environment pollution.

    Batteries contain highly hazardous element.

    Burning of rubber & Plastic in open area causes air pollution.
